These Terms of Use ("Terms") govern your use of ksanalytical.com (the "Site"), operated by KS Analytical Systems ("KSA," "we," "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
Use of the Site
You may use the Site for lawful purposes related to learning about and contacting KSA. You agree not to:
- Attempt to gain unauthorized access to the Site, its administration area, or related systems
- Interfere with or disrupt the Site or its hosting infrastructure
- Use automated means to scrape the Site at a rate that burdens it, or submit spam or false information through the contact form
- Use the Site in any way that violates applicable law or the rights of others
Content and intellectual property
The text, images, layout, and other content on the Site created by KSA are owned by or licensed to KSA and are protected by applicable intellectual property laws. You may view and print pages for your own internal business use. Any other copying, republication, or distribution requires our prior written permission.
Trademarks
Bruker, ICDD, MDI, JADE, and other product, company, and brand names and logos appearing on the Site are trademarks or registered trademarks of their respective owners. They are used to identify the products and services we sell and support. Their use on the Site does not imply ownership of, or endorsement by, those owners unless expressly stated.
Product and pricing information
Descriptions, specifications, images, and any pricing or availability information on the Site are provided for general information only. They are not an offer to sell. Specifications and availability may change without notice. Any sale, refurbished system, service contract, training, or analysis is governed by a separate written quote or agreement between you and KSA, and those terms control over anything on the Site.
Submitting inquiries
Information you send through the contact form is handled as described in our Privacy Policy (/privacy). Submitting a request does not create a contract or obligate either party to a purchase or service.
Third-party links and content
The Site links to and may embed third-party content, including store.ksanalytical.com, icdd.com, LinkedIn, and YouTube. We do not control those sites or content and are not responsible for them. Your use of them is subject to their own terms and policies.
Disclaimer of warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in these Terms limits any warranty stated in a separate written agreement with KSA.
Limitation of liability
To the fullest extent permitted by law, KSA and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of or inability to use the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Governing law
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. You agree that the state and federal courts located in Texas have exclusive jurisdiction over any dispute relating to the Site, except where the law requires otherwise.

We may update these Terms or the Site at any time. The effective date above shows when the Terms were last revised. Continued use of the Site after a change means you accept the updated Terms.
